1. The balance of purchase price is payable when the products have been delivered in accordance with the terms of the contract.

Payment is to be made to the DELIVERER in cash or cheque in favour of the company or by completed credit account documents

2. The customer will accept delivery, or provide reasonable access to enable DELIVERY to be completed as soon as advised that the units are ready. If within 6 weeks of such advice and appointment for delivery in accordance with the contract has not been fixed the balance of purchase price is then due and payable upon delivery that will follow at a mutual convenient date.

3. When the customer has ordered (by one or more products) a number of separate products, which can be supplied independently of each other, the company will endeavour to deliver such products at dates as close as possible to each other but:

  1. (a) the company shall be entitled to supply & deliver such products separately:
  2. (b) the company may render separate invoices in respect of each such product; and
  3. (c) payment in respect of each such invoice shall be due as provided in Paragraph 1 even though some or all of the products have not yet been supplied or delivered.

4. The delivery period quoted is that anticipated at the time of the order. If the product is not delivered within the delivery period stated in the contract the customer may serve notice on the supplier in writing requiring that the work be completed within such reasonable period as the customer may specify. The company will take all reasonable steps to meet agreed timescales. However the company cannot accept responsibility for delays out with their control on which basis time shall not be made essence of the contract

5.

  1. (a) The glass used is of the appropriate quality but may have minor imperfections as the company cannot supply to a higher standard than the manufacturers can provide. (BS No 6262). The glass is hermetically sealed double glazing and will comply to the visual quality of the glass and glazing standards and be guaranteed by the manufacturer for 10 years
  2. (b) The guarantee does not extend to damage or faults due to accident, misuse or neglect by the customer or other parties or any lead work not in a triple glazed unit.
  3. (c) In the case of a contract of sale rights set our in paragraph 5 are given in addition to and not it substitution for all the consumers rights under common law or by statue.
  4. (d) The company gives such undertakings as to the title as are implied by section 12 of the sale of goods act 1979.

6. No undertaking can be given that the customer’s existing doors, windows and or frames can be removed so as to fit for re-use or any other purpose. Also it is the client’s responsibility for disposal of old doors and windows (we recommend you notify local council refuse department prior to delivery from Clyde Doors & Windows to have old items removed from site as soon as possible

7. The customer is strongly advised to ensure that any representation or promise made before or at the time of signature to the contract not included in the printed form of the contract is added in writing on the face of the contract and signed by the customer and the company or its agent. In this way there is no doubt as to the terms of the representation or promise. Moreover failure to do so shall be relied upon in any subsequent dispute between the parties.

8. Customers are responsible for the disconnection of any electrical, alarm or communication cabling to their doors or windows and also any reconnection of any cabling.

9. All contracts have a period of seven days from the signed date in which to cancel contract this should be done by filling out the paragraph below and returning to the company

10. To Clyde Windows & Conservatories Limited. I/We (delete as appropriate) hereby give notice that I/we (delete as appropriate) wish to cancel my/our (delete as appropriate) contract …………………………………………………………………………………… (insert reference number, code or other details to enable the contract to be identified)
